We are not trying to be a large firm that answers quickly.

We are a small firm that never had to. The distinction sounds like marketing until the week something goes wrong, and then it is the only thing that matters.

What each one costs, and when to call somebody else.

The document is for the bad year

Nobody reads an operating agreement while everyone still likes each other. We draft for the meeting three years out, when one founder wants liquidity and the other wants control, and the only thing standing between them is a sentence somebody wrote quickly.

We have never merged, which means we have never had to run a conflicts check against an office in a city none of us has visited. When we say we can take your matter, the answer does not arrive from a committee.

Both times the arithmetic was appealing and both times it would have meant handing matters to people the client had never met. A firm that grows past the partners' capacity to read the documents has changed products without changing its brochure.

Straight answers

Ask these of every firm you interview.

How is a boutique different from a large firm, really?
Two things, and neither is service quality — large firms have excellent lawyers. The first is staffing: your matter is handled by partners rather than delegated down a pyramid. The second is conflicts. We are small enough to take on parties a national firm cannot touch because an office you have never heard of represents them.
Your hourly rate is higher than the firm I spoke with.
It usually is. The number that matters is the total, and a partner who drafts the agreement in four hours frequently costs less than an associate who takes fourteen and a partner who then reviews it. Ask any firm you interview for a total estimate, not a rate.
Will you take my case on contingency?
Sometimes, in part. Full contingency works when damages are large and liability is clear, which describes fewer cases than people hope. We will tell you honestly which category yours is in, including when the answer means we are not the right firm.
What happens in the first meeting?
You talk, we listen, and at the end we tell you what we think it is worth doing. Thirty minutes, no charge, no documents required. About a third of those conversations end with us recommending somebody else, which is not a failure of the meeting.
Can you handle a matter outside Arizona?
Frequently, through pro hac vice admission or with local counsel we have worked with before. What we will not do is pretend to a familiarity with a jurisdiction we do not have.
Is my first email confidential?
Not yet, and this matters. An unsolicited email does not create an attorney-client relationship and is not privileged. Tell us the general nature of the matter and nothing sensitive until we have confirmed we can represent you in writing.
