These Terms of Use govern your use of this website and any web design, development, SEO, advertising, or related services provided by Mesa Web Designers (“we,” “us,” or “the Company”). By using this site or purchasing our services, you agree to these terms.
Services
We provide website design and development, search engine optimization, paid advertising management, and related digital marketing services. The specific deliverables, scope, and timeline for your project are defined by the package you purchase or a written proposal we provide.
Orders and Payment
Prices are listed in U.S. dollars. Payments are processed securely through Stripe; we never see or store your full card details. Payment authorizes us to begin work. Because our work is custom and begins promptly, all payments are subject to our Refund Policy.
Project Timelines
We work fast and provide estimated timelines up front. Delivery depends in part on your timely cooperation — providing content, access, and approvals when requested. Estimated timelines are good-faith projections, not guarantees, and may shift if required materials or approvals are delayed.
Your Responsibilities
You agree to provide accurate information and any content, credentials, or access we reasonably need to perform the work. You are responsible for ensuring that materials you provide (text, images, logos) do not infringe the rights of others, and you grant us permission to use them to build and operate your project.
Intellectual Property
Upon receipt of full payment for a project, ownership of the final custom deliverables produced specifically for you transfers to you. We retain ownership of our underlying tools, frameworks, and pre-existing code, and we reserve the right to display completed work in our portfolio unless you request otherwise in writing.
Third-Party Services
Our work may rely on third-party platforms (for example Stripe for payments, Google and Microsoft for advertising and analytics, and hosting providers). Your use of those services is subject to their own terms, and we are not responsible for their availability, changes, or actions.
No Guarantee of Results
We build to the highest standard, but we cannot and do not guarantee specific outcomes such as search rankings, ad performance, traffic, leads, or revenue. Results depend on many factors outside our control, including your market, competition, and how leads are handled once delivered.
Limitation of Liability
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to our services is limited to the amount you paid us for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost business.
Termination
Either party may end an ongoing engagement with written notice. Work completed up to the termination date is billable, and payments already made remain subject to the Refund Policy.
Governing Law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Bexar County, Texas.
Changes to These Terms
We may update these terms from time to time. The “last updated” date above reflects the most recent revision. Continued use of the site or our services after changes take effect constitutes acceptance of the updated terms.
